TERMS & CONDITIONS (ITS HAUL)

Welcome to ITS HAUL. By accessing or using our website and services, you agree to comply with the following Terms & Conditions. Please read them carefully.


1. Scope of Service

ITSHaul acts strictly as a dispatch service provider and not as a motor carrier, freight forwarder, or broker. Our role is limited to administrative support, including load searching, rate negotiation, and document management. We do not take legal or physical possession of cargo.


2. Financial & Performance Liability

  • No Guarantee of Results: While we commit to maximizing your Revenue Per Mile (RPM), we do not guarantee specific income levels or the availability of loads on any given day.

  • Carrier Responsibility: The carrier remains solely responsible for the safe operation of their equipment, compliance with Hours-of-Service (HOS), and all FMCSA safety regulations.

  • Third-Party Delays: ITSHaul is not liable for financial losses resulting from shipper/receiver delays, equipment breakdowns, or “acts of God” that prevent the fulfillment of a booked load.


3. Cargo & Insurance

  • Damage Claims: Any claims regarding cargo loss or damage must be handled between the carrier and the broker/shipper insurance policies.

  • Liability Cap: In no event shall ITSHaul’s total liability for any service-related dispute exceed the amount of the dispatch fee paid for that specific load.


4. Dispatch Service Agreement

ITSHaul provides administrative dispatch services to Motor Carriers possessing active operating authority.

  • Role: We act as an independent contractor for the Carrier and do not represent the Shipper or Broker in any capacity.

  • Authority: By using our services, the Carrier grants ITSHaul the limited authority to negotiate rates and sign load confirmations on the Carrier’s behalf.

  • Carrier Status: The Carrier must maintain all required DOT and FMCSA compliance, including active insurance and an “Active” MC number.


5. Communication & Reporting

Effective logistics depends on real-time data and accurate reporting.

  • Check Calls: Carriers are required to provide timely status updates (Pick-up, In-Transit, and Delivery) to their assigned ITSHaul dispatcher.

  • Equipment Status: Carriers must immediately notify ITSHaul of any equipment breakdowns or mechanical failures that may result in a service failure.

  • Accuracy: Any information provided by the Carrier regarding equipment location, available hours, or trailer type must be 100% accurate to avoid TONU (Truck Ordered Not Used) claims.


6. Document Management & Confidentiality

Handling sensitive freight documents requires strict professional standards.

  • Paperwork Submission: Carriers must provide clear, legible copies of the signed Bill of Lading (BOL) and any accessorial receipts within 24 hours of delivery.

  • Data Privacy: All rate information, broker contact details, and proprietary lane data shared by ITSHaul are considered confidential and may not be shared with third parties.

  • Record Keeping: While ITSHaul assists with document management, the Carrier is responsible for maintaining their own permanent records for tax and audit purposes.


7. Governing Law & Dispute Resolution

This section establishes the legal framework for any disagreements.

  • Jurisdiction: These terms are governed by the laws of Pakistan, and any disputes relating to the service will be settled in the courts of Lahore.

  • Mediation: In the event of a dispute regarding service fees, both parties agree to attempt an informal resolution via mediation before pursuing formal legal action.

  • Severability: If any part of these terms is found to be unenforceable, the remaining sections will continue to be valid and binding.


8. Cancellations

Cancellations must be made in advance.
Loads already dispatched may incur a cancellation or TONU (Truck Ordered Not Used) fee.


9. Intellectual Property

All content, logos, text, and media on this site belong to ITS HAUL and may not be copied or reproduced without permission.


10. Changes to Terms

ITS HAUL may update these Terms at any time.
Continued use of the site means you accept any changes.


11. Operational Integrity

Employees must faithfully perform all assigned duties, comply with all company policies at all times, and ensure that all information provided to carriers and brokers is accurate to maintain the professional reputation of the company


 

12. Confidentiality and Commitment

During and after employment, employees are strictly prohibited from disclosing proprietary information, including carrier data and pricing, and must not engage in any activities or external employment that compete with or detract from their responsibilities to the company.
